End User Licence Agreement
Effective: 29 September 2026
This End User Licence Agreement ("EULA") is between you and Skycast, Inc. ("we", "us") and covers the Fantasy Stables app (the "App"). It works together with our Terms of Service and Privacy Policy, which also apply; if they conflict on something about the App itself, this EULA wins. By downloading or using the App you agree to this EULA.
1. Your licence
We give you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use the App for your own entertainment, on devices you own or control, as allowed by the rules of the store you got it from (Apple's Usage Rules in the App Store Terms of Service, or Google Play's terms). The App is licensed, not sold.
2. What you may not do
You may not, and may not help anyone else to: copy, modify, translate or make derivative works of the App; reverse engineer, decompile or disassemble it, except where the law allows despite this limit; remove or change any notice of ownership; rent, lease, lend, sell, sublicense or distribute it; use cheats, bots, automation or unauthorised software with it; get around any security or technical limit in it; or use it in any way that breaks the law or our Terms.
3. Ownership
We and our licensors own the App and everything in it, including its code, art, characters, music, names and virtual items, and all intellectual property rights in them. Virtual items are licensed to you as described in the Terms and have no value outside the App.
4. Updates and termination
We may update the App, and some updates may be needed to keep playing. This licence lasts until it ends. It ends automatically if you break this EULA, and you or we may end it at any time. When it ends you must stop using the App and delete it. Sections 3, 6, 7, 8 and 10 continue after it ends.
5. If you got the App from Apple
You and we agree that:
- Acknowledgement. This EULA is between you and us only, not Apple. We, not Apple, are solely responsible for the App and its content.
- Scope of licence. The licence in section 1 is limited to using the App on Apple-branded products you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed by other accounts associated with you through Family Sharing or volume purchasing.
- Maintenance and support. We alone are responsible for any maintenance and support of the App. Apple has no obligation at all to provide maintenance or support for it.
- Warranty. We alone are responsible for any product warranty, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are our sole responsibility.
- Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession or use of it, including (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.
- Intellectual property. If any third party claims that the App or your possession and use of it infringes that party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
- Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer name and address. Questions, complaints or claims about the App go to us: Skycast, Inc., 4316 Cherry Hill Dr, Orchard Lake, MI 48323, United States; hello@fantasystables.com.
- Third-party terms. You must comply with any third-party agreement that applies when using the App, such as your wireless data service agreement.
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and once you accept it, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
6. If you got the App from Google Play
Google is not a party to this EULA and is not responsible for the App. Your use of Google Play is governed by Google's own terms.
7. No warranty
To the maximum extent the law allows, the App is provided "as is" and "as available", with all faults and without warranty of any kind. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, and that the App will be uninterrupted, error-free or secure. Some places do not allow these exclusions, so some may not apply to you.
8. Limitation of liability
To the maximum extent the law allows, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, virtual items or goodwill, arising from the App, and our total liability for all claims relating to the App is limited to the greater of the amount you paid us in the 12 months before the claim or US $100. Nothing in this EULA limits liability that the law does not allow to be limited, including for death or personal injury caused by negligence, or for fraud.
9. Export
You may not use or export the App except as authorised by United States law and the laws of the place where you got it.
10. Law and disputes
This EULA is governed by the laws of the State of Michigan, United States, without regard to its conflict-of-law rules. Disputes are resolved as set out in the Terms of Service, including binding individual arbitration where the law allows. If you are a consumer in the EU or UK, you keep the protection of the mandatory laws of the country where you live.
